Irrevocable Trusts in Massachusetts
Lisa M. Neeley, Esq., Of Counsel at Mirick O’Connell, LLP, will discuss of the current state of irrevocable trusts in long-term care planning. Recently, Lisa successfully represented the plaintiff in the Massachusetts Appellate Court case of Heyn v. Director of the Office of Medicaid, 89 Mass. App. Ct. 312 (April 15, 2016), in which the Court ruled that an irrevocable trust was to be considered a non-countable asset for purposes of determining an applicant's eligibility for MassHealth long-term care benefits.
